Terms of Service

What changed on 9 October 2026: these terms now cover Serp Diary as well as Snake Measurer. Added: using the diary without a named account, sharing an animal and handing one over to another keeper, and where refunds are requested. Nothing previously granted to you has been withdrawn.

1. Acceptance of Terms

By accessing and using Snake Measurer ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Snake Measurer is a web and mobile application that allows users to measure snake length from photographs using reference objects. The Service provides measurement tools, history storage, and optional account features.

3. User Accounts

To access certain features, you may create an account using:

• Email and password
• Google Sign-In
• Apple Sign-In

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.1. Using Serp Diary Without an Account

Serp Diary can be used without creating a named account. Such an account is real and your records are stored on our servers, but the only proof that it is yours is a token held in your browser. We cannot restore access to it. If you clear your site data or move to another device, those records become unreachable, and we are not able to return them to you. Signing in attaches your name to the same account and removes this risk.

3.2. Sharing and Handing Over an Animal

You may invite another person to help with an animal, and you may hand an animal over to another keeper using a code. Both are arrangements between you and that person, not with us:

• Inviting someone shows them the email address of the animal's owner, and shows the owner their email address.
• Handing an animal over copies that animal's records into the other person's account and leaves you an archive copy. It is not reversible by us once accepted.
• Any sale, payment or agreement between keepers is entirely between them. We are not a party to it, take no fee from it, and cannot arbitrate it.
• You are responsible for what you hand over and to whom. Do not hand over an animal whose records contain information about a third person without their knowledge.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service for any illegal activity
• Attempt to gain unauthorized access to the Service
• Interfere with the proper functioning of the Service
• Upload malicious content or malware
• Use the Service to harm animals or promote animal cruelty

5. Intellectual Property

The Service, including its design, features, and content, is owned by SerpWidgets and protected by intellectual property laws. You may not copy, modify, or distribute our Service without permission.

You retain ownership of any images you upload. By using the Service, you grant us a limited license to process your images for measurement purposes only.

6. Measurement Accuracy

The measurements provided by Snake Measurer are estimates based on user input and image analysis. We do not guarantee the accuracy of measurements. Factors affecting accuracy include:

• Photo quality and angle
• Reference object placement
• User's point placement accuracy
• Snake positioning in the photo

For critical measurements (veterinary, scientific research), please use professional measuring tools.

7. Free and Premium Services

Snake Measurer offers both free and premium tiers:

• Free: Unlimited measuring, up to 30 saved measurements and 3 animal profiles, cloud sync. In Serp Diary: unlimited entries and state spans, 3 animals, 3 enclosures, one schedule, one entry type of your own and one helper per animal.
• Premium: Unlimited history, unlimited animal profiles, AI auto-detection, growth analytics, CSV/PDF export, and the diary's schedules, protocols and rules without limit.

Premium is available as a monthly subscription, annual subscription, or lifetime one-time purchase.

7.1. Subscription Terms

• Auto-Renewal: Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You can cancel your subscription at any time through the App Store, Google Play Store, or your account settings (for web purchases). Cancellation takes effect at the end of the current billing period — you retain access until then.
• After Cancellation: Nothing you have recorded is deleted, hidden or locked. Reading, editing, deleting and exporting your own records stays free on any plan; only adding beyond the free limits asks for premium again.
• Refunds: See 7.3 below.
• Price Changes: We may change subscription prices. Existing subscribers keep their current rate until the end of their billing period. You will be notified of price changes in advance.
• Free Trial: We may offer free trial periods. If you do not cancel before the trial ends, your subscription will begin and you will be charged.

7.2. Cloud Sync and Data Storage

• When signed in, your measurements, animal profiles, and photos are synced to our servers.
• Free accounts: the server stores up to 30 measurement records and 3 animal profiles. Reaching the limit stops new records from being added; it never deletes the ones you already have.
• Premium accounts: unlimited server-side storage for the duration of your subscription.
• You can delete your account and all server-side data at any time from the app settings.

7.3. Refunds

Premium is purchased through the app store you used — Apple App Store or Google Play — and their refund rules and timeframes apply. We do not process payments ourselves and cannot issue a refund on their behalf; requests go to the store that took the payment. Where a payment is made by another method we offer in future, the terms shown at the time of that payment apply. Nothing you have already recorded is withheld while a refund is being considered.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERPWIDGETS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the app settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through arbitration or in the courts of the applicable jurisdiction.
